This website, which we'll refer to as the "Website," is owned and operated by FlyBasis, LLC. (which we'll call "FlyBasis"). We provide various services (the "Services") through this Website, including the ability to book flights and other travel products (the "Travel Products") and the option to purchase our Ticket Protection Services. By using this Website or any of our Services, you're agreeing to accept all of the terms and conditions below (collectively, the "Agreement").

It's critical that you read this Agreement thoroughly. It has important details about limitations on our liability, what actions you can take, and restrictions on class action lawsuits. You'll also want to review our Privacy Policy https://www.flybasis.com/legal/privacy-policy, which applies to your use of the Website and forms part of this Agreement. By using this Website, making reservations for flights or other travel products, contacting our agents, or buying our Ticket Protection Services (all of these are included in the "Services"), you agree to the current version of this Agreement. We may need to make changes to the Agreement from time to time, and those changes take effect immediately. We'll let you know if we make any significant changes. If you continue to use our Website or Services after that, you're agreeing to those changes. If you're booking for a group, the group leader is responsible for making sure everyone in the group knows about this Agreement and is also financially responsible for the entire booking. We can't be held responsible if the group leader doesn't share this Agreement with everyone.

If you don't agree to all the terms in this Agreement, please don't use this Website, make any reservations through us, purchase any Travel Products, or use our Services.

USING THE FLYBASIS SERVICES AND WEBSITE

By using our Services and Website, you're confirming that:

FlyBasis has the right to prevent anyone from using this Website or the Services at any time, for any reason or no reason at all, including if you violate this Agreement. If you violate any part of this Agreement, your reservation could be canceled, you could lose any money you've paid, and you could be prevented from accessing the travel product or service.

CANCELLATIONS, CHANGES AND RESTRICTIONS

Revenue Tickets

Please be aware that general rules state that all tickets are non-refundable, non-exchangeable, non-transferable and non reroutable. By this we mean that you might not be able to make any of the changes above free of charge. If the airline policy allows any of the above changes, it will be subject to airline penalty if any, any applicable fare difference, as well as the 250 USD FlyBasis processing fee per person. If you don't show up for your flight ("NO SHOW"), your ticket has no value and you can't get a refund or exchange it.

Some of the airline's fare classes don't offer full benefits when it comes to frequent flyer miles and status points accrual. We have no control over their rules and all concerns and objections should be addressed directly to your operating carrier. Additional restrictions might apply.

Award Tickets

Please be aware that this is a very restrictive ticket and has a lot of limitations. If you are traveling on an award ticket you won’t be able to accumulate any frequent flyer or status points. Monetary refunds aren’t permitted unless “Ticket Protection Services” are purchased in addition to award tickets “Consultancy Services”. Changes are subject to award seat availability and might not be available on all flights and dates.

Please note that you aren’t purchasing an award ticket. The total amount indicated on the authorization form is the award ticket “Consultancy Fee”. By agreeing to the terms and conditions, you agree to give permission to FlyBasis to create a mileage account for the respective carrier involved in this booking using your credentials and/or allowing 3rd party mileage account holders to issue a ticket for you and other members in this booking. Additional restrictions might apply.

Upgradable Tickets

Please note that this ticket is an upgrade from a lower fare class and regular rules for “Revenue Tickets” will apply. Also, the original fare class rules and restrictions will apply regardless of the cabin you are traveling in. Free bags, seat assignment and business lounge access might not be included. The upgrade cost isn’t refundable and can’t be applied to another flight. Upgrade availability might not be available on all flights and/or dates. Additional restrictions might apply.

PAYMENT AND BOOKING

You'll need to get in touch with us directly to make a booking. To get you the best possible discount, we don't offer online booking. Once we've talked about your travel plans, our agents will search for the best options. This can take a few hours or a few days, depending on what you need.

By going ahead with the booking, paying for your Travel Products, or using our Services, you're acknowledging the service fee and agreeing to our fees and policies about refunds and cancellations.

You'll need to pay when you book, and the prices include a FlyBasis service fee that you can't get a refund for. We accept Visa, Mastercard, American Express, and bank wire transfers. Even though we take major credit cards, you'll need to give us electronically signed transaction authorization agreement, for each transaction. This authorization means we can charge your card, and you're giving up any right to a chargeback if you cancel for any reason (except fraud), including things outside of our control. You also agree to the refund policies explained in this Agreement. If you try to do a chargeback, reversal, or try to get your money back without our permission, we have the right to recover any costs, fees, or expenses associated with that, including legal fees. By using our Services, you accept and agree to our cancellation and chargeback policy. This means you understand that we consider the following to be improper chargebacks, and we have the right to fight them:

It's crucial that you check all parts of your booking right away to make sure everything is correct, including your names, address, email, phone number, date of birth, price, airfare, and arrival/departure airports. If anything is wrong, let us know immediately. You're responsible for any risks or costs if you don't report errors or things that are missing. You also need to make absolutely sure that the Passengers' first and last names are correct – they must match their legal names and the names on their travel documents exactly.

GENERAL RULES AND CONDITIONS

Name Changes: Name changes aren't allowed. Only the person whose name is on the ticket (the original Passenger) can use it

No-Show Tickets: If you don't show up for your flight ("no-show") and haven't canceled beforehand, your ticket has no value and can't be used. This means you won't be able to get a refund or use it for future travel credit. Also, any connecting flights linked to that booking, including your return flight, will be automatically canceled.

Travel Segments: You have to use your ticket in the order of travel segments that we issued it in. You can't change the order of your flights.

Checking In: For international flights, we recommend getting to the airport at least 3 hours before your flight departs to check in. This applies even if you have a domestic flight before your international flight. FlyBasis isn't responsible if you miss your flight because you're late for check-in or don't get to the gate on time. If you miss your flight, talk to the airline staff at the airport first, as they might be able to put you on a different flight. If that doesn't work, contact your FlyBasis agent.

Missed Flights: We can't give you a refund or let you exchange your ticket if you miss your flight. Any changes or replacement flights depend on what the airline allows. FlyBasis will do its best to help, but we can't guarantee you'll get on another flight.

Baggage for Connecting Flights: If you have separate bookings for different parts of your trip, you're responsible for transferring between flights and making your connections. You might have to collect your bags and check them in again, and you're responsible for doing this on time and going through security.

Schedule Changes: Airlines can change flight times, schedules, and the aircraft they use at any time. These changes might affect your itinerary. Airlines can also cancel flights or entire trips if they need to. Make sure to check your booking regularly, and at least 72 hours before your flight, to see if there are any changes. You can also check the airline's website for the latest flight information.

Overbooking and Flight Replacement:Sometimes airlines sell more tickets than there are seats on a flight (overbooking), which can lead to people being denied boarding. If this happens to you, contact your FlyBasis agent right away. Your ticket is guaranteed up to the amount you originally paid. FlyBasis will get you a new ticket within 72 hours or find other travel options for you within that time. You agree to give us 24 hours from your original flight departure time to fix any problems with your booking.

Frequent Flier Programs: Most of the fares FlyBasis offers are heavily discounted, so you might not earn frequent flyer miles or points. Upgrades, vouchers, and other discounts might not apply to your tickets either. You might not earn miles for all parts of your trip. If you have questions about frequent flyer programs, talk to your FlyBasis agent before you book your flights.

Baggage Allowance: Airlines have rules about how much your bags can weigh, their size, and how many you can check. You might have to pay extra at the airport if your bags don't follow the airline's rules. Some airlines don't let you check any bags for free. Baggage rules and fees can vary and change, so check with the airline for the latest information. You're responsible for paying any extra baggage fees.

Special Requests/Dietary Needs: If you have any special requests, like needing wheelchair assistance or having dietary restrictions, let us know when you book. Our agents will pass your requests on to the airline or travel supplier, but we can't be held responsible if they can't fulfill your requests.

VISAS, TRANSIT VISAS, AND OTHER TRAVEL DOCUMENTS

It's your responsibility to make sure you meet the entry requirements of the countries you're traveling to. This includes having the right travel documents, like a valid passport and any necessary visas (transit, tourist, business, etc.). FlyBasis doesn't have to advise you on visa or travel document requirements, and we're not responsible if you can't board your flight or enter a country because you don't have the correct documents. Your passport needs to be valid for at least 6 months from your travel date. Before you book any international travel, it's important to check travel restrictions, warnings, and advisories issued by the relevant government agencies.

Some countries don't allow one-way tickets, so check the rules before you depart. You might also need a visa or health card for certain destinations. Make sure you have all the required documents when you check in for your flight. It's a good idea to check the visa requirements for all your stops, including transit stops, as some countries require a transit visa even if you're not staying there.

You should contact the embassy or consulate of the countries you're visiting for the most up-to-date information on passports, visas, and other travel documents. Requirements can change, so check before you book and again before you leave. Some countries might have entry fees or departure taxes that you'll have to pay at the airport. These fees are your responsibility. We can't be held liable if you're not allowed on your flight or into a country because you don't have the correct travel documents, even if you're just transiting through and don't leave the airport.

INTERNATIONAL TRAVEL: HEALTH AND DISINFECTION

Health: Vaccination recommendations can change, so talk to your doctor about what you need before you travel. You're responsible for meeting all health entry requirements, getting the recommended vaccinations, taking any necessary medications, and following your doctor's advice related to your trip.

Disinfection: Some countries require aircraft to be sprayed with insecticide before or during a flight. For more information about this, please visit the Department of Transportation's Disinfection Information page:https://www.transportation.gov/airconsumer/spray

YOUR BEHAVIOUR

We expect all travelers to behave responsibly and follow the rules set by FlyBasis and our travel suppliers. FlyBasis and our suppliers can remove you from a flight, airport, hotel, or any part of your trip if your behavior seems dangerous or disruptive, or if it interferes with the safety and security of others. If this happens, you won't get a refund.

When you book with FlyBasis, you're responsible for any damage or loss caused by you or anyone in your group. You'll have to pay for any damage right away (we can estimate the cost if the exact amount isn't known). You also agree to cover us for any claims made against us because of your actions, including legal costs. We're not responsible for any costs if you're removed from a flight, airport, or any part of your trip. You agree not to hold FlyBasis or anyone connected to us responsible for any actions we take under these terms and conditions. You're responsible for your baggage and personal belongings at all times.

You must follow all laws and regulations of any place you visit during your trip. Pay close attention to the laws about drugs. We have a zero-tolerance policy for drug use or possession. If you don't follow this rule, you'll be in breach of this Agreement. Please drink responsibly for your safety and the safety of others. If you're asked to leave a trip because of bad behavior, violence, or any other disruptive actions, you won't get a refund.

TICKET PROTECTION SERVICES

FlyBasis may offer extra services to help you if your trip is disrupted or if you need to cancel. These aren't insurance plans, but they can offer some added flexibility. We call these "Ticket Protection Service”

Passenger Rights: Sometimes, airlines have to compensate passengers if flights are canceled, delayed, or disrupted. You might have these rights even if you don't buy our Ticket Protection Services. Our services just offer a quicker and easier way to rebook or get a refund without dealing directly with the airline. For more details about your passenger rights, check the U.S. Department of Transportation's regulations and the airline's website.

DISCLAIMER: ASSUMPTION OF RISK

When FlyBasis offers travel to certain destinations, especially international ones, we're not saying those places are safe or risk-free. We're not responsible for any problems you might have while traveling, including injuries, losses, or even death.

Traveling, especially to remote places, can be risky. There's a chance of injury or death from things like car accidents, animals, dangerous roads, slips and falls, crime, terrorism, government actions, bad food or water, extreme weather, and accidents or illness in places with limited medical help. You could also experience fatigue, overheating, or health problems. There's also the risk that someone helping you, like a tour guide or medical provider, might not be properly trained.

This list of risks isn't complete. There could be other unexpected things that happen, and you could get injured, sick, or even die. By traveling, you're accepting these risks and uncertainties. You agree to take full responsibility for anything that happens and not to hold FlyBasis responsible for any claims related to your trip, even if it's due to someone else's negligence. This agreement also applies to your family and anyone else connected to you. This part of the agreement remains in effect even if the rest of the agreement is canceled or terminated.

FlyBasis isn't responsible for any information you give us that is inaccurate, outdated, or incomplete. We're also not responsible for making sure you have the right travel documents or visas, even if something on our website or in our documents says otherwise.

We don't make any promises about our services, website, or travel products. Just because we offer a travel product doesn't mean we endorse or recommend it. We provide everything "as is" without any guarantees. We don't guarantee that our website, services, or emails are free of viruses or errors, or that they'll always be available.

There might be mistakes in the information on our website or in our documents, like wrong prices or incorrect information about travel documents. We don't guarantee that everything is accurate, and we're not responsible for any mistakes. We have the right to correct any errors, including prices.

LIMITATION OF LIABILITY

The travel suppliers we work with are independent companies, not our employees or agents. We don't control them in any way. Your travel documents are subject to the supplier's terms and conditions. You agree that FlyBasis and our team aren't responsible for anything the travel suppliers do or don't do, and we're not liable for any injuries, losses, or expenses that result from their actions. We're also not responsible if there are delays, cancellations, overbookings, strikes, or other things outside of our control.

To the extent allowed by law, FlyBasis and our team are not responsible for any damages you might experience related to this agreement, the travel products, or using our website or services. This includes things like lost profits, damage to your reputation, or problems caused by computer viruses.

Our total liability to you is limited to the service fee you paid us and $10 for any other issues. You agree that our service fees reflect the level of risk involved and that we wouldn't offer these services without these limitations.

LIMITATION ON ACTION

If you want to take legal action against us related to this agreement, you have to do it within one year of the event that caused the problem.

INDEMNITY

You agree to protect FlyBasis and our team from any claims, losses, or expenses that happen because you break this agreement, violate any laws, or cause damage related to your travel.

MISCELLANEOUS

This agreement is the complete agreement between us. If any part of it is invalid, the rest of the agreement still applies. If we don't enforce a part of this agreement, it doesn't mean we're giving up that right. Any unclear language in this agreement won't be used against the party who wrote it. The parts of this agreement that need to remain in effect after the agreement is terminated will continue to apply.
